Welcome to Still By Your Side. The terms “we”, “us” and “our” refer to Still By Your Side. Still By Your Side operates this website and service, including all related information, features, tools, and services, to provide you with AI-generated, handwritten-style letters from the perspective of deceased pets (the “Services”). Still By Your Side is powered by Shopify, which enables us to provide the Services to you.

By visiting our site and/or purchasing a subscription, you agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein and/or available by hyperlink.

SECTION 1 - ACCESS AND ACCOUNT

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence. To use the Services, you may be asked to provide certain information, such as your email address, billing, and details regarding your pet. You represent and warrant that all information provided is correct, current, and complete. 

SECTION 2 - NATURE OF SERVICES (READ CAREFULLY)

Our Service utilizes Artificial Intelligence (AI) and robotic handwriting technology to create physical letters.

  • AI Generation: You acknowledge and agree that the content of the letters is generated by AI based on the inputs you provide. These letters are fictional, creative works designed for comfort and entertainment purposes. We make no claims that these letters are spiritual communications, channeled messages, or actual contact with the deceased.

  • Novelty Nature: You acknowledge that this Service is a novelty product powered by technology. It is not a psychic service, mediumship, or spiritual communication tool. Any resemblance to actual spiritual messages is purely coincidental and generated by predictive text algorithms.

  • User Inputs: The quality and personalization of the letters depend heavily on the accuracy and detail of the information you provide about your pet. We are not responsible for inaccuracies in the letters resulting from incorrect or vague user inputs.

  • Handwriting: The letters are written using robotic plotting technology to simulate handwriting. They are not handwritten by a human scribe.

SECTION 3 - ORDERS

When you place an order, you are making an offer to purchase. We reserve the right to accept or decline your order for any reason.

Right to Refuse: We reserve the right to refuse to generate content that we, in our sole discretion, deem to be inappropriate, offensive, hateful, or that violates our AI content safety guidelines. In such cases, your order will be cancelled and refunded.

SECTION 4 - PRICES AND BILLING

Prices for our products are subject to change without notice.

  • Terms: If you purchase products, you authorize us to charge your payment method according to the price and term selected.

  • Cancellation: You may cancel your subscription at any time.

  • Refunds: Cancellations are subject to our Refund Policy, which allows for prorated refunds for un-generated letters. Please review the Refund Policy carefully.

SECTION 5 - SHIPPING AND DELIVERY

All delivery times are estimates. We are not responsible for delays caused by shipping carriers or events outside our control. Please note that because each letter is custom-generated and "handwritten" by machine, there is a production lead time before shipping occurs.

SECTION 6 - GIFT ORDERS AND THIRD-PARTY RECIPIENTS

If you are purchasing Services to be delivered to a third party (a "Recipient") other than yourself, you represent and warrant that:

  1. You have the consent of the Recipient to send them postal mail regarding their deceased pet; OR

  2. You have a sufficiently close relationship with the Recipient to reasonably believe that receiving such a letter will be welcomed and will not cause emotional harm, trauma, or distress.

You acknowledge that receiving a letter "from" a deceased pet is a highly emotional experience. You agree that Still By Your Side is solely a service provider acting on your instructions. You assume full liability for any emotional reaction, distress, or trauma experienced by the Recipient. We reserve the right to refuse fulfillment of orders to third parties if we suspect the Service is being used to harass, stalk, or cause distress to the Recipient.

SECTION 7 - INTELLECTUAL PROPERTY & USER CONTENT

  • Our IP: The "Still By Your Side" brand, the website design, and the underlying code/methods used to generate the letters are owned by us.

  • Your License to Us: By submitting details, stories, or names regarding your pet ("User Content"), you grant us a worldwide, royalty-free license to use that data specifically for the purpose of generating your orders.

  • Information Regarding Minors: If your User Content includes the names, ages, or stories involving minors (individuals under the age of 18), you represent and warrant that you are the parent or legal guardian of said minor(s), or have obtained explicit permission from the parent or legal guardian to disclose this information for the purpose of generating the letter. You agree not to submit full names, addresses, or other personally identifiable information of minors unrelated to the production of the letter.

SECTION 8 - OPTIONAL TOOLS

We may provide you with access to third-party tools (such as order tracking or payment gateways) over which we neither monitor nor have any control. You acknowledge that we provide access to such tools ”as is” without any warranties.

SECTION 9 - THIRD-PARTY LINKS

Certain content, products, and services available via our Service may include materials from third parties. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites.

SECTION 10 - RELATIONSHIP WITH SHOPIFY

Still By Your Side is powered by Shopify. You acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Still By Your Side, including any injury, damage, or loss resulting from purchased products and services.

SECTION 11 - PRIVACY POLICY

Your submission of personal information through the store is governed by our Privacy Policy.

SECTION 12 - ERRORS, INACCURACIES AND OMISSIONS

We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information or cancel orders if any information in the Service is inaccurate at any time without prior notice.

SECTION 13 - PROHIBITED USES

In addition to other prohibitions as set forth in the Terms of Service, you are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to submit false or misleading information; (d) to upload or transmit viruses or any other type of malicious code; (e) for any obscene or immoral purpose; (f) to intentionally inflict emotional distress on any individual; (g) to impersonate any person, entity, or famous animal, including but not limited to pets with a significant social media following, trademarked characters, or animals owned by third parties without their express permission; (h) to use the Service as a tool for "grief-baiting," harassment, or to send unwanted communications to individuals who have expressed a desire not to be contacted by you.

TO THE FULLEST EXTENT PERMITTED BY LAW, STILL BY YOUR SIDE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE.

SECTION 15 - INDEMNIFICATION

You agree to indemnify, defend and hold harmless Still By Your Side and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service. This indemnification obligation specifically includes any claims brought by a third-party Recipient of the Services alleging emotional distress, trauma, invasion of privacy, or similar claims arising from the receipt of letters ordered by you.

SECTION 16 - SEVERABILITY

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service.

SECTION 17 - GOVERNING LAW

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of Washington, United States.
